Is is legal for an unauthorized BMW repair person to use BMW software to Flash

EGS unit? This is an unauthroized BMW repair person claiming to be a BMW specialist. He "Flashed EGS u nit with updated software", to try to fix a trouble light that came on every morning at the cold start next to the gear/transmission indicator. The update he did did not correct the light problem. Irrespective of the light problem itself, I would appreciate it if you can tell me how he was able to access this software, when he is not an authorized BMW dealer/mechanic and if it legal for him to do so. Thanks in advance for your info.

There's no law against this kind of stuff. So yes, it is legal.

In general anybody can work on any kind of car. It may not be a good idea, but BMW has no special protection under the law. In fact many car manufacturers try to hide their special diagnostic code so independent repair shops CANNOT work on their cars. But their efforts have been defeated and the US courts have mandated that all manufacturers publish their diagnostic codes so ANY independent shop can work on ANY car (if they feel competent).
