What is lemon law?

Lemon laws are American state laws that provide a remedy for purchasers of cars that repeatedly fail to meet standards of quality and performance. The customers can get refund of their money, replacement vehicle or cash compensation with our FREE Attorney help.

Each state law differs. All the states covers a brand new vehicle under the lemon law, but only some of them also cover used vehicles and leased vehicles.

In California, lemon laws cover anything mechanical, as do the federal lemon laws. The federal lemon law also provides that the warranter may be obligated to pay the prevailing party's attorney fees in a successful lemon law suit, as do most state lemon laws.

Lemon laws are not limited to cars. There are RV lemon laws, boat lemon laws, motorcycle, wheelchair and computer lemon laws.

What is covered under lemon law?

The defect cannot be something minor such as flaws in the paint job, minor repairs, or cosmetic wear. It must be something that needs repeated repairs within the time frame. The time line and major defect prove the car is unsafe or inoperable.

After purchase, your car may need some repairs. This is not the time to look into the lemon law. Initial repairs should be covered under your vehicle warranty or extended warranty. A vehicle warranty and an extended warranty cover different time lengths and parts of the car. Read your vehicle warranty to determine time and parts covered; some provide free repairs for all parts for the first six months. The lemon law applies after you use the vehicle warranty for repairs and continue to experience numerous problems with the car.
 
Lemon law for used cars

NEW vehicles are covered under most states lemon laws. We know this already. But not for used vehicles sold "as is" and not person-to-person sales. However, there is lemon law for used cars only in some states like CT, MA, NJ, MN, NM and NY.

For example say the state of Minnesota. Minnesota's Used Car Lemon Law provides for the following;

1.It applies to all cars, pick up trucks and vans that cost more than $3,000, are less then 8 years old and have less than 75,000 miles on them and the car hasn?t been previously salvaged.
2.The dealer must give a warranty of a certain duration depending on the miles of the car at the time sold.
3.The dealer must repair or replace the part that is defective or at the dealer?s election refund the purchase price to the consumer.
4.If a repair is performed the dealer must continue to warrant the repair for the original duration of the first warranty.
5.Attorneys? fees are paid by the defendant.

Today I thought of posting information specific to a state. To start with its California.

California’s Song-Beverly Consumer Warranty Act is commonly referred to as the California Lemon Law. It was enacted to protect consumers in having to deal with a defective vehicle that meet one of the criteria referenced above.

The California Lemon Law applies to vehicles

•In the first eighteen (18) months or first eighteen thousand (18,000) miles, after vehicle delivery
•Repaired for serious safety problem at least two (2) times
•Required repairs four (4) or more times for the same problem
•Out of service for a cumulative total of thirty (30) or more days
